Welcome to heyGF.AI. These Terms of Service ("Terms") govern your access to and use of the heyGF.AI website, mobile application, and AI companions (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

heyGF.AI provides AI-powered companionship through conversational agents designed to simulate conversation and interaction. Our Service is intended for users who are at least 18 years of age.

2. Usage Guidelines

By using our Service, you agree to abide by the following guidelines:

• You will not use the Service for any illegal or unauthorized purpose
• You will not attempt to probe, scan, or test the vulnerability of our systems
• You will not attempt to reverse engineer or decompile any part of the Service
• You will not harass, threaten, or abuse our AI companions in ways that would be harmful if directed at a human
• You will not attempt to trick or manipulate the AI into generating content that violates our content policies
• You will not share or distribute explicit content generated through our Service without consent
• You will not download, save, or attempt to extract any media (including images, videos, or audio) from our Service. We discourage and do not approve any downloading of media content from our platform

We reserve the right to terminate or restrict your access to the Service if we determine, in our sole discretion, that you have violated these guidelines.

3. Subscriptions and Payments

heyGF.AI offers both free and premium subscription services. By purchasing a premium subscription, you agree to pay the applicable fees. Subscriptions automatically renew until cancelled by you.

You may cancel your subscription at any time through your account settings. After cancellation, your subscription will remain active until the end of your current billing period. We do not provide refunds for partial subscription periods.

We reserve the right to change our subscription fees upon reasonable notice. Such notice will be provided via email and/or a prominent notice on our Service.

4. Refund Policy

Subscription Services: When you cancel a subscription, it will remain active until the end of your current billing period. We do not provide refunds or credits for any partial subscription periods.

One-Time Purchases: All one-time purchases, such as coin packs or custom media, are final and non-refundable.

Exceptional Circumstances: We may consider refunds on a case-by-case basis for billing errors or service malfunctions. Please contact support@heygf.ai for such cases. All such refund requests will be evaluated at our sole discretion.

5. Service Delivery and Timing

Digital Delivery: All services and products offered on heyGF.AI are delivered digitally to your account within our Service. No physical goods are shipped.

Subscription Services: Access to premium features under a subscription plan is granted immediately after your payment is successfully processed.

One-Time Purchases: Coin packs are credited to your account instantly upon successful purchase.

6. User Content and AI-Generated Content

When you engage with our AI companions, you may provide input and receive AI-generated responses, images, and other content (collectively, "Content").

You retain ownership of your input content. By providing input to our Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and process your input for the purpose of providing and improving our Service.

For AI-generated content, including images and text, you receive a license to use such content for personal, non-commercial purposes. Any commercial use requires explicit written permission from heyGF.AI.

7. Content Reporting, Takedown, and Dispute Resolution

7.1 Reporting Violations

heyGF.AI is committed to maintaining a safe and lawful platform. If you encounter content that you believe is illegal, violates these Terms of Service, the standards of card associations, Epoch, or any of our payment partners, please report it to us immediately by emailing support@heygf.ai. We will review and investigate all reported complaints and aim to resolve them within seven (7) business days. In the event that such review yields evidence of illegal content, we will remove that content immediately.

7.2 Content Removal Requests by Depicted Individuals

Our content is 100% AI generated, with methods that ensure that no real person is harmed or exploited. If you believe that you are being depicted in any content on our Service and you wish to request its removal, please contact us at support@heygf.ai. We will undertake a reasonable process to confirm whether appropriate consent was obtained for the use of your likeness in the content. If consent cannot be confirmed, or if you can demonstrate that your consent is void under applicable law, we will remove the content immediately.

If heyGF.AI disagrees that your consent is void under applicable law, we will allow such disagreement to be resolved by a neutral third party, and heyGF.AI will bear the expense of such dispute resolution.

8. Privacy and Data

Our collection and use of personal information in connection with the Service is described in our Privacy Policy. By using our Service, you acknowledge and agree to our data practices as described therein.

While we implement reasonable security measures, no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security of your data.

9. AI Companions and Limitations

heyGF.AI provides AI companions that simulate conversation and companionship. You acknowledge and agree to the following:

• Our AI companions are not human and do not have consciousness or emotions
• Responses are generated by AI algorithms and may not always be accurate or appropriate
• AI companions cannot provide medical, legal, financial, or professional advice
• Generated images are created by AI and do not depict real individuals
• The Service is designed for entertainment and companionship only
• We make no guarantees about the availability, reliability, or performance of our AI companions

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure, that defects will be corrected, or that the Service or the servers that make it available are free of viruses or other harmful components.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HEYGF.AI, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, OR SYSTEM FAILURE.

In no event will our aggregate liability exceed the amount you paid for the Service in the twelve (12) months preceding the claim or one hundred dollars ($100), whichever is greater.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice through the Service or by other means. Your continued use of the Service after such notice constitutes acceptance of the modified Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without giving effect to any principles of conflicts of law. Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules.

You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. Any claim must be brought within one (1) year after the cause of action arises.
